• You are responsible for keeping your password secure. You commit to (a) promptly inform Flirtflix of any unauthorized access to your password or account or any other security breaches, and (b) make sure you log out of your account after each session when using the Services. Flirtflix will not be responsible for any loss or harm resulting from your non-adherence to this section.
• Users should not form genuine emotional dependencies or replace real human interactions with the AI chatbot.

4. Medical Disclaimer & Emergencies

Flirtflix offers software and content aimed at enhancing your mood and emotional well-being. However, we are not a medical or healthcare entity, and our Services shouldn't be viewed as medical treatment, mental health counseling, or any professional service. Only a qualified physician or healthcare professional can provide such services. We do not assert, represent, or guarantee any therapeutic benefits from our Services.

The Services are not intended for emergency situations. 6. No Refund Policy

At Flirtflix, all sales and transactions are final. We do not offer refunds, exchanges, or credits for any services, subscriptions, or products once they have been purchased. Before making a purchase, we encourage users to thoroughly review the details and specifications of the service or product they are interested in. By using our Services and making a purchase, you acknowledge and agree to this no refund policy.

Please note that for EU citizens, abiding by the EU regulations, if you contact us at the email above for a refund within 14 days after making a purchase and before consuming any paid content on our website, Telegram or any other channel, we will process a refund for you. However, you agree to lose your right to refund if you consume our paid content after making a purchase. This is based on the exemptions allowed under the EU regulations for online digital content.

• Endorse or engage in any illegal or unauthorized activities.
• Access materials or information not intentionally made available through the Services.

10. Disclaimer of Warranties

YOUR UTILIZATION OF THE SERVICE IS ENTIRELY AT YOUR OWN DISCRETION. THE SERVICE IS OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS. FLIRTFILX CATEGORICALLY RENOUNCES ALL WARRANTIES, WHETHER THEY ARE EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, SUITABILITY FOR A SPECIFIC USE, OWNERSHIP, AND NON-VIOLATION.

FLIRTFILX DOES NOT GUARANTEE THAT:

• (I) THE SERVICE WILL FULFILL YOUR SPECIFIC NEEDS,
• (II) THE SERVICE WILL BE UNINTERRUPTED, PROMPT, SECURE, OR FREE FROM ERRORS,
• (III) THE OUTCOMES DERIVED FROM USING THE SERVICE WILL BE PRECISE OR TRUSTWORTHY, OR
• (IV) THE STANDARD OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIALS ACQUIRED OR SECURED BY YOU THROUGH THE SERVICE WILL ALIGN WITH YOUR ANTICIPATIONS.

11. Limitation of Liability

YOU CLEARLY ACKNOWLEDGE AND AGREE THAT FLIRTFILX SHALL NOT BE RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS INCLUDING, BUT NOT RESTRICTED TO, DAMAGES FOR LOSS OF REPUTATION, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF FLIRTFILX HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, ARISING FROM:

• (I) YOUR USE OR INABILITY TO USE THE SERVICE;
• (II) ANY COSTS INCURRED TO OBTAIN SUBSTITUTE GOODS OR SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES BOUGHT OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS INITIATED THROUGH OR FROM THE SERVICE;
• (III) UNAUTHORIZED ACCESS TO OR MODIFICATION OF YOUR DATA OR TRANSMISSIONS;
• (IV) CONDUCT OR STATEMENTS OF ANY THIRD PARTY ON THE SERVICE;
• (V) ANY OTHER ISSUE RELATED TO THE SERVICE.

FLIRTFILX'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU HAVE PAID TO FLIRTFILX IN THE PAST SIX (6) MONTHS OR ONE HUNDRED US DOLLARS (USD 100).

IF YOU ARE NOT SATISFIED WITH ANY ASPECT OF THE SERVICES OR THESE TERMS OF SERVICE, YOUR ONLY RECOURSE IS TO STOP USING THE SERVICES.

IF ANY PART OF THESE SECTIONS IS FOUND TO BE UNENFORCEABLE UNDER LAWS, THE UNENFORCEABILITY OF THAT PART WILL NOT AFFECT THE REMAINING PORTIONS OF THE APPLICABLE SECTIONS.

12. Indemnification

You commit to indemnify, defend, and hold harmless Flirtflix, its affiliates, and their respective officers, directors, employees, and agents (collectively referred to as the “Indemnitees”) from and against any and all losses, damages, liabilities, costs, and expenses, including reasonable legal fees and expenses, resulting from or related to your use of the Services, any content you provide, your connection to the Services, your breach of these Terms of Service, or your infringement of any rights of another party.

Despite the above, you will not be obligated to indemnify or shield any Indemnitee from any liability, losses, damages, or expenses caused by that Indemnitee's own negligent or intentional act or omission. If you are a resident of California, you relinquish your rights under California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” If you reside outside of California, you forgo any analogous statute or principle in your jurisdiction.

13. Entire Agreement

These Terms of Service represent the complete understanding between you and Flirtflix and oversee your utilization of the Service, replacing any previous agreements between you and Flirtflix concerning the Services. Additionally, when using affiliate or third-party services, third-party content, or third-party software, you may be bound by additional terms and conditions.

14. Jurisdiction

These Terms of Service will be governed by the laws of India, without regard to its conflict of law provisions. Concerning any disputes or claims not subject to arbitration, you and Flirtflix agree to submit to the personal and exclusive jurisdiction of the courts located in India. The failure of Flirtflix to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of such right or provision. If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms of Service remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Services or these Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred. A printed version of this agreement and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. You may not assign these Terms of Service without the prior written consent of Flirtflix, but Flirtflix may assign or transfer these Terms of Service, in whole or in part, without restriction. The section titles in these Terms of Service are solely for convenience and carry no legal or contractual significance. Notices to you may be delivered via email or regular mail or by any chat messaging service. Flirtflix may also convey notices of changes to these Terms of Service or other matters by displaying notices or links to notices generally on the Service.
